The reality is that 67% of minor children in South Africa do not grow up with both biological parents in one household. This represents about 13 million children who require maintenance to take care of their basic needs in terms of their financial provision. Parents are faced with many challenges through the current maintenance system. Social Justice Maintenance Services renders a variety of specialised services to parents who are affected by maintenance orders and non-compliance thereof.

1. Applying for a Maintenance Order for the First Time 

If you are a parent or legal guardian and you do not have a maintenance order or a parenting plan to regulate maintenance payments for your child, we can assist you through the process of mediation to get such an order. You can refer your case for mediation and we will assist you to appoint a mediator to assist you with the process. Some of these services are available free of any charges.

2. Applying for an Increase or Decrease of an Existing Maintenance Order 

If you are a parent or legal guardian and you have an existing maintenance order or a parenting plan that regulates the maintenance payments for your child, we can assist you through the process of mediation to replace that order with a new order. You can refer your case for mediation and we will assist you to appoint a mediator to assist you with the process. Some of these services are available free of any charges.

3. Recovery of Arrears Maintenance on an Existing Maintenance Order 

If you are a parent or legal guardian and you have an existing maintenance order or a parenting plan that regulates the maintenance payments for your child that is in arrears, we can empower you to make use of the various processes offered by the recovery system.  Some of these services are available free of any charges.

The traditional processes for the recovery of arrears maintenance through the maintenance system may be a challenging process for some, but this system offers a recovery management facility for a fee, which can be utilised by subscribers to recover arrears maintenance. The facility has features to assist subscribers to populate a wide range of actions in the recovery process.

4. Tracing and trace alerts on the Credit Bureau

Some primary caregiver parents have to deal with the challenges of absconded or missing parents that do not contribute towards the maintenance of their children, or whose whereabouts are unknown and they are untraceable for legal purposes. Social Justice Maintenance Services assist subscribers to trace for a fee.

5.Maintenance calculators

Social Justice Maintenance Services offers a range of other services to assist subscribers to deal with their challenges in maintenance matters, including calculators for arrears maintenance plus interest, and how much each parent should contribute toward maintenance, proportionately according to their means.
